We handle appeals in both Oregon and Washington state appellate courts and in the Ninth Circuit Court of Appeals. With a proactive approach to appellate advocacy, we have created a great deal of appellate precedent favorable to our clients in insurance coverage litigation, negligence law regarding foreseeability, and liquor liability.
One notable victory in our appellate department was a ruling that the construction defect statute of ultimate repose applies to third party claims for indemnity and contribution. Before that appellate ruling many trial courts refused to apply the statute to third party claims against subcontractors.
